Shiba Commission Terms and Conditions

1    AGREEMENT TO TERMS

These Terms and Conditions constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”) and Miijii-San (“Shiba”, “Shiba’s”, “Commissioner”), concerning your ability to request commissions.You agree that by requesting for a commission or commissions, you have read, understood, and agreed to be bound by all these Terms and Conditions. If you do not agree with all these Terms and Conditions, they you are expressly prohibited from using, posting, sharing, monetizing, selling, tracing, copying, or manipulating the original works of Shiba in any way.Supplemental terms and conditions or documents that may be posted on any of Shiba’s existing platforms from time to time are hereby expressly incorporated herein by reference. Shiba reserves the right, in Shiba’s sole discretion, to make changes or modifications to these Terms and Conditions at any time and for any reason.We will alert you about any changes by updating the “Last Updated” date of these Terms and Conditions, as well as make an announcement on any of Shiba’s social platforms, and you waive any right to receive specific notification of each such change.It is your responsibility to periodically review these Terms and Conditions to stay informed of updates. You will be subject to and will be deemed to have been made aware of and to have accepted the changes in any revised Terms and Conditions by your continued use of Shiba’s commissions services after the date such revised Terms and Conditions are posted.The information provided on any of Shiba’s social platforms is not intended for distribution to or use by any person or entity in any jurisdiction or country where such distribution or use would be contrary to law or regulation or which would subject us to any registration requirement within such jurisdiction or country.Accordingly, those persons who choose to request commissions from other locations do so on their own initiative and are solely responsible for compliance with local laws if and to the extent local laws are applicable.


2    GENERAL RULES

1) A max of 2-3 commission slots will open every month. Shiba will not take more commissions unless one of them is completed and delivered ahead of schedule.2) The price of the requested commission is multiplied based on the number of characters in an artwork (if you request more than one character to be drawn).3) Drawings can take between 1 week to 2 and a half months depending on what you want and the complexity of the character or artwork.        a. If an estimated date is given to you but the delivery time exceeds the due day by half its duration, your price will be reduced by 50% moving forwards.        b. If delivery time exceeds the due day by its full duration, 50% off; double the duration; completely free!        c. Upon the first past due date (over by half the duration of the estimated time for the commission to be completed), whatever process you are on is partially refundable.                i. What is refunded to you is the price different between the original price and the reduced price (e.g. If requested “Flat Color” for 1 character in a shot, the refund amount will be $21).        d. The only process excluded from this rule is the full render. They will ALWAYS be NON-REFUNDABLE!4) Before any proceedings start, initial sketches will be $10.        a. If you happen to be younger than 18 years old, initial sketches are FREE, and all menu prices will be reduced by 50%. However, you must be accompanied and given permission by a parent and/or guardian prior to any proceedings.        b. The parent/guardian will be the primary Point of Contact for any commission requests or changes.5) Unless specifically requested by you, Shiba has the right to post, share, and display Work-In-Progress (WIP) and/or completed commissions that have been done for you.        a. The post or thread made by Shiba may have you tagged or referred to if links or profiles exist.


3    INITIAL REQUESTS, UPGRADES AND CHANGES

1) Decide what kind of commission you want on initial! Depending on what you want, your estimate will be based on that prior to the initial sketch.2) Upgrading involves actions such as requesting line art of a character but during the process you decide you want to add flat colors to it. You must pay for the initial request to the upgraded request. So again, decide what kind of commission you want prior to initial sketching.        a. You are permitted to request 3 changes at all phases excluding the last 2 phases (highlights/shadows and full render).        b. Every additional change is a $10 fee.        c. Actions such as deciding if you want flat colors instead of just line art during the process also count as a change, so you must pay the difference between processes AND the $10 fee to apply the change.3) Shiba has the right to refuse any requests made or services provided to you for any reason whatsoever. (The decision is final, and no reviews or background checks will be made)


4    PERMITTED REQUESTS AND ACTIVITIES

1) All characters from any form of media!        a. It can be a character from an anime, manga, light novel, visual novel, video game franchise, etc.        b. This also includes OCs you own and/or your likeness!        c. If you wish for Shiba to create an OC for you from scratch, you must provide adequate references of accessories, body type, color palette, clothes, etc.        d. If you provide no adequate references upon request, a $25 fee is added to your final estimate.        e. Good news is, your OC is YOURS to keep!!! After drawing your OC, it will now be YOUR intellectual property after delivery and finalization of purchase.        f. The artwork in question, however, still retains its copyright, including all reproduction rights and the right to claim statutory copyright unless otherwise specified here. The artwork cannot be reproduced or altered without the written consent of Shiba.2) Showing any sort of undergarments (panties, bras, lingerie’s) (You must be at least 16+ for this option)3) Requesting a commission in which involves suggestive or explicit sexual themes and/or nudity. (You must be at least 18+ for this option)4) Requesting a commission involving bare feet!5) Requesting to draw a Loli or Shota or commissioning the creation of an OC that is a Loli or Shota.        a. Lolis or Shotas are defined as characters that have a petite, small frame, and/or all or some of their features and/or mannerisms are of a child-like or infantile nature.                i. Typically, age does not matter as they are fictional drawings and have no impact or harm on real-life children. But most consider Lolis or Shotas to be of the underaged variety.        b. Unless age and/or race has been disclosed for a character, they MUST be clothed!        c. If you insist of not having a Loli or Shota clothed, they must AT LEAST be of an appropriate age where the age they are at (based on species or race) is at or over a level of maturity or of the age consent IF specified or referenced directly from the original author, artist, VTuber or VTuber Agency, or overall source material.        d. If Section 4.c is not applicable, then they must AT LEAST be of the age 18 or older for nudes to be requested of them.6) The drawing of furries.        a. They must AT LEAST be standing on 2-legs or on their hind legs, and they must be clothed to adhere to “Limitations” Section 2 and 3.7) Drawings of Kemonomimi characters.        a. This includes but are not limited to: Cat girls, Dog girls, Horse girls, Shark Girls, Whale Girls, Orca Girls, Slime Girls, Lamia, Kobald, Harpy, etc.8) An existing character or your OC that is LGBTQ+ (This will include commissions where you request Shiba to create an OC for you)9) Backgrounds.        a. If it is just patterns with a couple of gradients, no charges will be applied to your estimate.        b. If you want to add a scene or any sort of complex background, a $15 to $100 fee is added to your estimate. The exact value is upon the discretion of the commissioner.10) To Post or to use your commission(s) for anything you want if that Shiba has been credited appropriately.        a. If you would like Shiba’s signature to be removed, you can request it after completion of commission request (you will be provided with the signed and unsigned versions)11) You are allowed to use any of Shiba’s prior works or the work that was commissioned for you as a reference for you or someone else.


5        LIMITATIONS AND PROHIBITED REQUESTS AND ACTIVITIES

1) Only Waifus (female anime, manga, light novel, visual novel, video game, cartoon, or VTuber/PNGTuber characters of any sort) will be accepted!        a. This also included the OC that you own or request to be created.2) A new character added in the same shot is considered a separate process!3) Nudity is only limited to boobs (showing a character lactating is allowed). [You must be at least 18+ for this option. Exceptions can be made in the discretion of Shiba]4) No explicit sexual acts of ANY kind will be drawn! However, suggestive acts of a sexual nature are allowed!5) No harm of ANY kind will be caused to the character(s) Shiba draws. OC(s), whether yours or requested to be created by Shiba, are not exempted.6) Shiba’s signature will be added and remain adhered to the commissioned work unless stated otherwise.7) No haggling! Such behaviors will NOT be tolerated (a ZERO-TOLERANCE RULE), and you will be blacklisted.8) There will be no attempts at belittling, doxxing, defaming, or harassing of any kind to Shiba or the clients that Shiba services.        a. If you want to notify Shiba of a person(s) that may be problematic or have malicious intent, a Formal Investigation and Review Request (FIRR) must be submitted. Requests to fill out an FIRR form can be submitted via Shiba’s Discord Server.        b. This is a ZERO TOLERANCE rule and will result in you getting blacklisted.9) You will NOT feed any of Shiba’s original works of art of any generative AI, AI Model, or LLM of any kind (free or on a subscription model)10) You will not change or modify the art or use in a way that is dishonest, deceitful, disrespectful, or of malicious intent.11) Unless the commission is using your OC or the commission is upon the request of creating an OC for you, all other characters will maintain their intellectual properties and copyright, and thus not allowed to use those characters in anyway unless you have explicit permission from the copyright holder or original creator of that character.


6    DECLARING THE USAGE OF AI

SHIBA DOES NOT CONDONE OR APPROVE OF THE USAGE OF PRORIETARY, FREE, OR PERSONAL AI OR LLMs FOR THE GENERATION OR CREATION OF ART!If you TRULY insist on having the idea of feeding any of Shiba’s prior works or the work that has been commissioned to you to AI, you agree to the following terms and conditions:1) You must sign a Declaration of Usage Form declaring that upon receiving the initial sketch of Shiba’s work (and ONLY the initial sketch) you plan and/or intend to feed it into AI model of any kind that you are using and pay an upfront fee of $300.2) If it is reported, relayed, disclosed, or made known to Shiba that you have fed his image to AI without my explicit permission or consent, legal action may be taken against you and will be considered a violation of intellectual property.3) If you insist on feeding Shiba’s work to AI, you are limited to only receiving an initial sketch.        a. The Initial Sketch fee will be added on top of the upfront fee of $300.4) Approval of feeding Shiba’s work to AI is with his strict and explicit discretion.5) A background check may be initialized, and you must sign a document stating that upon receiving the sketch, you understand that you have officially declared that you plan and/or intend to feed Shiba’s work into an AI of any kind.6) If that it's found that you feed Shiba’s prior works and/or delivered commission to AI without the strict and explicit consent of Shiba, you understand that legal actions may be made against you, and you will be fined the upfront fee of $300 on top of all processes that the AI have gone through (Sketch, Line Art, Flat Colors, Highlights, Shadows, and Full Render.7) Additionally, whichever AI model or LLM you used, if that AI model is based on a subscription model, the annual price of their highest plan option will be added to your charge.        a. If the AI model or LLM derives from a code repository (GitHub, GitLab, etc.), the annual price of their highest plan option will be added to your charge instead.8) Any monetization made or revenue generated with the usage of AI from Shiba’s prior works or delivered commissions, with no exceptions, is required to pay back the amount they had made in full. Failure to comply will result in a $3400.00 fine.
